I . General provisions
The Regulations set out the rules for the provision of services electronically on the website www.medicadent.com.pl by Medicadent Stomatologia Sp. z o.o The Regulations are regulations within the meaning of Article 8 of the Act of July 18, 2002 on the provision of services by electronic means, and the applicable law is Polish law. Medicadent shall make the Regulations available free of charge on the website www.medicadent.com.pl in a form that makes it possible to download, record, reproduce and print them. Each User shall be obliged to become familiar with the content of the Regulations before using the Service and to comply with its provisions. Terms used in these Regulations shall have the following meanings:
- Medicadent – Medicadent Stomatologia Sp. z o.o., with its registered office in Poznań, 110a Piątkowska Street, 60-649 Poznań, holding the NIP number 7811952554, owner of the Service;
- Service – the website www.medicadent.pl;
- User – a person using the Service;
- Services – the possibility of using the Website provided by Medicadent free of charge, in particular to access the Website, the information contained therein, contact Medicadent, make an appointment and subscribe to the electronic Newsletter;
- Agreement – an agreement for the provision of services by electronic means, i.e. services performed by sending and receiving data via data communications systems without the simultaneous presence of the parties, whereby the data are transmitted via telecommunications networks within the meaning of the Telecommunications Law.
The Regulations are regulations within the meaning of Article 8 of the Act of July 18, 2002 on the provision of services by electronic means, and the applicable law is Polish law. The Agreement shall be concluded upon the User’s declaration of acceptance of these Terms and Conditions, without the need for a separate agreement, which may be done explicitly by the User’s confirmation of this fact or implicitly, if the User continues to use the Service after becoming familiar with the Terms and Conditions. The Agreement may also be terminated by the User leaving the Service, without the need for additional statements of intent.
II . Technical conditions for the use of the Service
In order to use the Service, the following are required:
- access to the Internet;
- Internet Explorer, Google Chrome, Safari, Firefox and Opera browsers in the latest versions, with cookies and Java Scripte enabled.
Medicadent does not guarantee the proper functioning of the Service if the User uses hardware and software that does not meet the technical requirements specified in the Terms of Service. Provision of the Services may also be interrupted in the event of inadequate connection quality, damage to or defects in telecommunications equipment, power systems, computer equipment, failure of the telecommunications network or power outages. Interruptions due to technical work are possible in the proper functioning of the Service. The data entered into the Service is protected by a secure, encrypted connection using HTTPS and using SSL data encryption. It is possible to use the Service with mobile devices. The Service contains documents in PDF format, which can be opened in a web browser or using the free Adobe® Reader program.
III . Rules of use of the Service
The Service is available 24 hours a day, seven days a week. The use of the Service is free of charge, the user bears the costs of Internet connection, according to the tariff of his operator. The User shall have the opportunity at any time to review the content of these Regulations, which are maintained on the Service. It is forbidden for the User to provide unlawful or offensive content to the Service, as well as for the User to take actions in the use of the Service that are contrary to the Regulations or that may cause interference with the use of the Services or damage to the Service. Medicadent shall not be liable for the consequences of the User’s use of the Service in a manner contrary to these Terms and Conditions. If the implementation of the Services requires the User to provide certain data, the User undertakes to provide data that is true, complete and not misleading. The User shall be solely and entirely responsible for the consequences of any erroneous, false or outdated data provided by the User, including with respect to third parties whose data the User has used without their knowledge or consent. Medicadent shall not be liable for any errors in the use of the Site, in particular those related to data transmission interruptions, Site malfunctions or computer viruses, if they occurred through no fault of Medicadent. The Service contains content protected by intellectual property rights, in particular trademarks and other intangible property subject to copyright protection. Accordingly, the User, when using the Service, is obliged to comply with the intellectual property laws.
IV . Services provided on the Service
Medicadent shall provide the following Services to the User via the Service:
- o access the Website, including learning about Medicadent’s current offerings;
- to contact Medicadent;
- arranging the date and type of service provided by Medicadent;
- to subscribe, upon consent, to Medicadent’s electronic Newsletter.
V . Data protection
Medicadent is the administrator of Users’ personal data. In all matters related to the processing of his/her personal data, the User may contact Medicadent by writing to the e-mail address: [email protected]. Medicadent processes Users’ personal data:
- in order to provide electronic services to Users on the Website (Article 6 sec. 1, b GDPR), for the duration of the performance of the Agreement and, after its termination, for the period after which claims under the Agreement become time-barred;
- for the purpose of enabling the User to contact Medicadent, to arrange the date and type of service, or to subscribe to the electronic Newsletter (Article 6 sec. 1, a GDPR), for the duration of the request to delete the User’s personal data;
- for analytical and statistical purposes, to conduct analysis of Users’ activities and preferences and use of the Website, in order to improve the functionality of the Website and services provided through it (Article 6 sec. 1, f GDPR), until such time as a User successfully objects to their data being processed;
- for technical, administrative and security purposes of the Site and its administration, to rectify possible failures and errors (Article 6 sec. 1, f GDPR), until you successfully object to their processing of your User data.
Users’ personal data may be shared by Medicadent with Medicadent’s employees and associates, as well as with third parties responsible for maintaining the Service. Medicadent shall not transfer Users’ personal data to other countries, in particular outside the European Economic Area (which includes the European Union, Norway, Liechtenstein and Iceland) or to international organizations. User has the right to access the content of his/her data, the right to rectify, delete, limit processing, the right to object and the right to request data portability, as well as the right to withdraw consent to the processing of his/her data at any time without affecting the legality of the processing that was performed on the basis of consent before its withdrawal. The User may make a request to exercise his/her rights by writing to: [email protected]. User has the right to lodge a complaint regarding the processing of personal data to the supervisory authority, which in Poland is the President of the Office for Personal Data Protection. User’s personal data shall not be used by the Organizer for profiling or automated decision-making.
VI . Complaints
The User may at any time file complaints regarding the provision of Services on the Service. Medicadent recommends submitting a complaint as soon as the User becomes aware of his/her concerns, which will affect the accuracy and speed of its processing. The complaint may be submitted electronically to the e-mail address: [email protected]. Consideration of the complaint and response will be made without undue delay, but no later than within 30 days of receipt of the complaint. In particularly complicated cases that make it impossible to consider the complaint and provide a response within 30 days, the deadline for consideration of the complaint and providing a response may be extended to 60 days from the date of receipt of the complaint, of which the User will be notified. Medicadent shall notify the User of the method of processing the complaint immediately after its consideration in electronic form or, if so requested by the User, in writing.
VII . Final provisions
Medicadent shall have the right to amend these Terms and Conditions at any time by posting the current version on the Service. The User, by using the Service after the amendment to the Terms and Conditions, accepts the changes made. The recognition of individual provisions of these Regulations, in whole or in part, as inconsistent with the provisions of generally applicable law, shall not affect the validity or effectiveness of the remaining provisions of the Regulations. The invalid provision will be replaced by the provision that is closest to the objectives of the invalid provision and the Regulations as a whole. In matters not regulated by these Regulations, the provisions of generally applicable law shall apply. Any disputes arising in connection with the use of the Site or application of these Terms and Conditions shall be settled by the court having jurisdiction over the seat of Medicadent.
